Section 504 Informational Notice

Section 504 is an act which prohibits discrimination against persons with a disability or impairment in any program receiving federal financial assistance. The act defines an individual with a disability or impairment as anyone who:

• has a physical or mental impairment which substantially limits one or more major activity (major life activities include activities such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, working, reading, concentrating, thinking, sleeping, waiting, performing manual tasks, and various major bodily functions including operation of "the immune system, normal feel growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, endocrine, and reproductive functions."
• has a record of such impairment
• is regarded as having such an impairment

In order to fulfill its obligation under section 504, Sweetwater County School District Number One recognizes a responsibility to avoid discrimination in policies and practices regarding its personnel and students.  No discrimination against any person with a disability or impairment will knowingly be permitted in any of the programs and practices in the school district.

The school district has specific responsibilities under the Act, which include the responsibility to identify, evaluate and provide a free appropriate education to all students who are individuals with disabilities or impairments as defined by eligibility under section 504. The parents of these students are entitled to procedural safeguards, including individual notice of eligibility, notice of development of a plan, and notice of a significant change in a plan.  If the parent or guardian disagrees with the determination made by the professional staff of the school district , he/she has a right to a hearing with an impartial hearing officer. The family education right and privacy act (FERPA) specifies rights related to educational records.
